Dealing with the insurance company on your own is NOT something we recommend. Unfortunately, too many people are under the misapprehension that when they are injured due to someone else’s negligence, the insurance company is on their side. Nothing could be further from the truth.

Remember, insurance companies are NOT in business to pay out claims to people who have been injured, they are in the business of making money for their shareholders.

At The Noll Law Firm, we’ve seen many examples of clients who make the mistake of thinking the insurance adjusters who call them after they’ve been injured are their friends. Wrong. What usually happens is the liability carrier for the other party (or parties) involved in or responsible for your personal injury calls you to “make sure you’re okay” and to obtain some information from you. If that happens, say nothing. If they ask for a written statement or report, don’t do it. If they ask whether they can record your conversation, absolutely refuse to give your permission.

In fact, the less you say to the insurance company, the better off you’ll be. Remember, accidents or incidents that cause personal injury rarely are cut and dry. Insurance companies for the other side will look for any and all “proof” your personal injury was a result of your own negligence.

In a car accident, an insurance company may argue that you weren’t paying attention or that you were going too fast to stop. In a motorcycle accident that carries with it its own set of biases, an insurance company might argue that you weren’t obeying the proper riding rules of the road.

In a construction accident, an insurance company might argue that you weren’t performing your job properly, and so on.
